1. Uvodne določbe

1.1. Ti splošni pogoji uporabe in poslovanja (v nadaljevanju: “Pogoji”) urejajo pravice in obveznosti med podjetjem Marketing in storitve, Artjom Bajdak, s.p., Begunje na Gorenjskem 79, 4275 Begunje na Gorenjskem, Slovenija, Matična številka: 6928145000, Davčna številka: SI30957508 (v nadaljevanju: “Ponudnik”) in uporabniki spletne strani passionista.co (v nadaljevanju: “Uporabnik”) ter kupci spletne trgovine (v nadaljevanju: “Kupec” ali “Kupci”).

1.2. Z vstopom na spletno stran in uporabo njenih vsebin ter storitev se Uporabnik strinja s Pogoji. Če se Uporabnik s Pogoji ne strinja, mu uporaba spletne strani ni dovoljena.

1.3. Splošni pogoji so skladni z zakonodajo Republike Slovenije.

2. Registracija in varstvo osebnih podatkov

2.1. Uporabnik se lahko registrira v spletno trgovino ali uporablja storitve kot gost. Registracija omogoča hitrejši in enostavnejši postopek nakupa.

2.3. Uporabnik je dolžan zagotoviti točne in resnične podatke pri registraciji in nakupu. Ponudnik ne odgovarja za posledice napačno vnesenih podatkov.

3. Ponudba izdelkov in storitev

3.1. Spletna trgovina ponuja izdelke in storitve, ki so na voljo do razprodaje zalog.

3.2. Cene so navedene v evrih (€) in vključujejo DDV, razen če je izrecno navedeno drugače.

3.3. Ponudnik si pridržuje pravico do spremembe ponudbe in cen brez predhodnega obvestila. Spremembe ne vplivajo na že sklenjene pogodbe.

4. Naročanje in plačilo

4.1. Kupec izbere izdelke, jih doda v košarico, izpolni potrebne podatke in zaključi nakup.

4.2. Na voljo so naslednji načini plačila:

• Kreditna kartica (Visa, MasterCard)
• PayPal
• Bančno nakazilo

4.3. Pogodba o nakupu je sklenjena, ko Ponudnik potrdi prejem plačila. Kupec prejme potrdilo o naročilu na e-poštni naslov.

5. Dostava

5.1. Ponudnik zagotavlja dostavo na območju EU z uporabo partnerskih dostavnih služb.

5.2. Stroški dostave so navedeni ob naročilu in so odvisni od destinacije in teže naročila.

5.3. Ponudnik se trudi dostaviti naročilo v roku 3-5 delovnih dni, razen v primerih višje sile ali nepredvidenih dogodkov.

6. Pravica do odstopa od pogodbe

6.1. Kupec ima pravico, da v 14 dneh od prejema blaga odstopi od pogodbe brez navedbe razloga.

6.2. Kupec mora obvestiti Ponudnika o odstopu in vrniti blago na naslov Ponudnika v 14 dneh od obvestila.

6.3. Ponudnik bo vrnil celotno kupnino, vključno s stroški dostave, v 14 dneh po prejemu vrnjenega blaga.

7. Reklamacije in vračila

7.1. Kupec ima pravico do reklamacije v primeru, da izdelek ni skladen z naročilom ali ima napako.

7.2. Kupec mora Ponudnika obvestiti o reklamaciji in vrniti izdelek na naslov Ponudnika v 30 dneh od prejema.

7.3. Ponudnik bo zamenjal izdelek ali vrnil kupnino v 30 dneh po prejemu reklamiranega izdelka.

8. Omejitev odgovornosti

8.1. Ponudnik ne odgovarja za morebitne zamude pri dostavi ali napake pri izdelkih, ki so posledica višje sile ali nepredvidenih dogodkov.

8.2. Ponudnik ne odgovarja za škodo, ki bi nastala zaradi neprimerne uporabe izdelkov ali storitev.

8.3. Uporabnik uporablja spletno stran in njene vsebine na lastno odgovornost. Ponudnik ne odgovarja za morebitno škodo, ki bi nastala zaradi uporabe spletne strani ali vsebin.

9. Varstvo avtorskih pravic

9.1. Vsebine, objavljene na spletni strani, so last Ponudnika ali tretjih oseb in so zaščitene z avtorskimi pravicami.

9.2. Uporaba vsebin za komercialne ali javne namene brez dovoljenja Ponudnika ni dovoljena.

12. Reševanje sporov

12.1. Vse spore, ki izhajajo iz uporabe spletne strani ali nakupa v spletni trgovini, bosta stranki reševali sporazumno.

12.2. Če sporazum ni mogoč, je za reševanje sporov pristojno sodišče v Sloveniji.

13. Končne določbe

13.1. Ti Pogoji veljajo od 15.6.2024 do preklica ali spremembe.

13.2. Uporabnik se z uporabo spletne strani strinja, da je seznanjen s Pogoji in jih sprejema.
